Esvon Classifieds End User License Agreement


	LICENSE GRANT

	"You" means the person or company who is being licensed to use the 
	Software or Documentation. "We" means Esvon, LTD. "Esvon Classifieds" 
	is the program (collectively, the "Software") whose license and usage 
	are detailed in this agreement.

	TITLE

	We remain the owner of all right, title and interest in Esvon 
	Classifieds and related explanatory written materials ("Documentation").

	ARCHIVAL OR BACKUP COPIES

	You may copy Esvon Classifieds for back-up and archival purposes, 
	provided that the original and each copy is kept in your possession 
	and that your installation and use of Esvon Classifieds does not 
	exceed that allowed in this agreement.

	TERMS OF USAGE

	Esvon Classifieds and Documentation are protected by United States 
	and International copyright laws. Use of Esvon Classifieds is subject 
	to the following terms:

	1. You may use only one instance of Esvon Classifieds on only one 
	computer solely for your own personal or business use, subject to 
	all other terms of this Agreement.
	However you are allowed to have another instance installed for 
	development/backup purposes at the same or another server 
	which is not available to the public.

	2. You may not use the source code in whole or part in any other 
	software or product and you agree to prevent unauthorized copying 
	of the Software.

	3. You may not reverse engineer, decompile, or disassemble the Software.

	4. You may not give, sell, distribute, sub-license, rent, lease or 
	lend any portion of Esvon Classifieds or Documentation to anyone. 
	You may not place Esvon Classifieds onto a server so that it is 
	accessible via a public network such as the Internet for distribution 
	purposes. Esvon retains all rights to distribute Esvon Classifieds, 
	under its own license, and reserves the right to revoke the license 
	of any user who is holding an invalid license.
	However you can request a permission to sell your domain license 
	to a third party. 
	Esvon may elect to accept or reject your license sale application 
	for any reason at its sole discretion.

	5. If you fail to use Esvon Classifieds in accordance with the terms 
	and conditions of this License Agreement, it constitutes a breach 
	of the agreement, and your license to use the program is revoked. 
	If Esvon becomes aware of any breach of the terms of this Agreement, 
	it may terminate your license and use of Esvon Classifieds pursuant 
	to the terms set out in the Paragraph entitled Term and Termination 
	below.

	6. The URL of the site where Esvon Classifieds is running must be 
	submitted to Esvon and all keys obtained must be used only for the 
	domains they are allowed for.

	7. You are bound to preserve the copyright information intact, this 
	includes the text at bottom, unless you purchased "Powered By" 
	removal option.

	8. You may modify the source code and customize the "look and feel" of 
	the SOFTWARE PRODUCT for your personal usage on the licensed installation 
	only.

	9. You agree that we may list your website in our promotional material, 
	including our website for as long as you are using the Software.

	10. We ask you not to use this Software for adult websites, we believe
	in Jesus Christ and are sure adult business is a sin.
	We will not provide any kind of support or customization services to
	adult websites.

	11. Esvon reserves the right to change this license agreement at any 
	time and impose its clauses at any given time.

	LIMITED LIABILITY

	WE WILL NOT BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST 
	PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES 
	ARISING FROM THE USE OR THE INABILITY TO USE ESVON CLASSIFIEDS OR 
	FOR ANY CLAIM BY ANY OTHER PARTY INCLUDING NEGLIGENCE.

	REFUND POLICY

	THE SOFTWARE PRODUCT AND THE ACCOMPANYING FILES ARE LICENSED TO 
	YOU "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR 
	MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  
	BY PURCHASING OR USING THE SOFTWARE PRODUCT, YOU ACKNOWLEDGE AND AGREE 
	THAT THERE SHALL BE ABSOLUTELY NO REFUNDS FOR ANY REASON WHATSOEVER, 
	INCLUDING FAILURE TO INSTALL THE PROGRAM, A CHANGE IN MARKET CONDITIONS, 
	A CHANGE IN BUSINESS OR WEB SITE STRATEGY, A CLAIM THAT THE PRODUCT 
	DOES NOT SUIT YOUR NEEDS OR IS NOT WHAT YOU EXPECTED, MODIFICATIONS 
	OF THE SOURCE CODE IMPLEMENTED BY THE USER THAT ALTER THE FUNCTIONALITY 
	OF THE SOFTWARE PRODUCT OR THAT ARE NOT IN ACCORDANCE WITH THE 
	DOCUMENTATION ACCOMPANYING THE SOFTWARE PRODUCT, THE UNAVAILABILITY 
	OF ESVON SOFTWARE FOR CUSTOMIZATIONS TO THE SOFTWARE PRODUCT, OR FOR 
	ANY OTHER REASON.

	BY PURCHASING OR USING THE SOFTWARE PRODUCT, YOU ACKNOWLEDGE THAT YOU 
	HAVE EXERCISED DUE DILIGENCE IN ASCERTAINING THAT THE SOFTWARE PRODUCT 
	WILL RUN ON YOUR WEB SERVER AND THAT IT WILL MEET YOUR NEEDS.

	TERM AND TERMINATION

	This license agreement takes effect upon your use of Esvon Classifieds 
	and remains effective until terminated. Esvon retains the right to 
	terminate your license to use Esvon Classifieds at any time, if in its 
	sole discretion, you are not abiding by the terms of the Agreement, 
	including, but not limited to, obscuring or removing any link or copyright 
	notice as specified in this agreement. You may terminate it at any time 
	by destroying all copies of Esvon Classifieds and Documentation in your 
	possession, subject to the other terms in this paragraph. You agree, on 
	termination of this license, to destroy all copies of the Software and 
	Documentation in your possession. If you continue to use Esvon Classifieds 
	after Esvon gives you written notice of termination of your license, you 
	hereby agree to accept an injunction to enjoin you from its further use, 
	and to pay all costs, including reasonable attorneys fees, to enforce 
	Esvon 's revocation of your license, and any damages suffered by Esvon 
	because of your misuse of Esvon Classifieds.
